Terms of Service
These Terms of Service (“Terms”) are a legal agreement between you and YOE 99WAWAH Inc, 1708 Holly Ct, Radcliff, KY 40160, United States (“we”, “us”, “our”), and govern your use of this website, its video player and all related content and features (the “Service”).
By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement of a parent or guardian. Series rated 16+ contain mature themes and are not intended for children. By using the Service you represent that you meet these requirements.
2. The Service
The Service is a free, advertising-free streaming catalogue of original short-form drama at launch. We may add, remove or change series, episodes, features and availability at any time. We do not guarantee that any particular title will remain available, and we may withdraw the Service or any part of it without notice.
We do not currently require an account and do not currently sell subscriptions. Playback position, saved series and likes are stored locally in your browser. If we introduce accounts or paid features, we will disclose the relevant terms and pricing before you use them.
3. Licence to use the Service
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, personal licence to access and view the Service for private, non-commercial entertainment. We reserve all rights not expressly granted.
You may not:
- Copy, download (other than through functionality we provide), redistribute, publicly perform, broadcast, sell, rent, sublicense or commercially exploit any content.
- Circumvent, disable or interfere with security, digital rights management, access controls or usage limits.
- Scrape, crawl, mirror or systematically extract content or data, or use bots or automated means to access the Service.
- Reverse engineer, decompile or attempt to derive source code, except where such restriction is prohibited by law.
- Remove or alter copyright, trademark or other proprietary notices.
4. Content, ratings and fictional characters
All series, characters, dialogue and events depicted in the Service are fictional. Any resemblance to actual persons, living or dead, or to actual events is coincidental. Series carry age ratings and content descriptors, which are shown on each series page and explained in our Content Guidelines.
Content may include mature themes such as betrayal, infidelity, family conflict, threats and fantasy violence. You are responsible for choosing content that is appropriate for you and for anyone in your household.
5. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation, or infringe the rights of any person.
- Harass, threaten, defame or harm another person.
- Upload or transmit malware, or attempt to gain unauthorised access to our systems or another user’s data.
- Interfere with the operation of the Service or impose an unreasonable load on our infrastructure.
- Impersonate any person or entity, or misrepresent your affiliation.
6. Intellectual property
The Service and all content, including video, artwork, music, text, graphics, logos, user interface and software, are owned by or licensed to YOE 99WAWAH Inc and are protected by United States and international copyright, trademark and other laws. “YOE 99WAWAH Inc” and associated marks may not be used without our prior written permission.
7. Copyright complaints (DMCA)
If you believe content on the Service infringes your copyright, send a written notice to our designated agent at ujmizd@3522288.xyz with the subject “DMCA notice”. Your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material claimed to be infringing, including its URL and enough detail for us to locate it.
- Your name, address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.
We may remove or disable access to material that is the subject of a valid notice and may terminate access for repeat infringers. If you believe material was removed by mistake, you may send a counter-notice to the same address with the information required by 17 U.S.C. § 512(g).
8. Your submissions
If you send us feedback, ideas or other materials, you grant us a non-exclusive, worldwide, royalty-free licence to use them to operate and improve the Service. Do not send us confidential information or material you do not have the right to share.
9. Third-party services
The Service may link to third-party websites, app stores or platforms. We do not control and are not responsible for third-party content, policies or practices. Your use of a third-party service is governed by its own terms.
10. Disclaimer of warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND UNINTERRUPTED OR ERROR-FREE OPERATION. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YOE 99WAWAH Inc AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or intentional misconduct.
12. Indemnity
You agree to indemnify and hold harmless YOE 99WAWAH Inc from any claims, damages, liabilities, costs and reasonable legal fees arising from your breach of these Terms or your misuse of the Service.
13. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict-of-law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in McCracken County, Kentucky, except that either party may seek injunctive relief in any competent court. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.
14. Changes to these Terms
We may revise these Terms from time to time. The revised version will be posted on this page with a new “Last updated” date. Material changes apply prospectively, and your continued use after the effective date constitutes acceptance.
15. General
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Content Guidelines, are the entire agreement between you and us regarding the Service. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
